Overview

Under the NSW Privacy and Personal Information Protection Act (PPIPA) 1998 and the NSW Health Records and Information Privacy (HRIPA) Act 2002, an individual has a right to access and amend records held by Council which contain their personal details including information about their health. Where information about an individual is held in documents, files or systems that include information about other persons, any request should be made under the GIPA Act. The Act provides for consultation with other affected parties prior to disclosure of information.

What sort of Information can I seek?

Personal information is any information or opinion about an individual person whose identity is apparent or can reasonably be ascertained. It will often include a person's name but can often include other information such as an address, financial and/or health matters.

Information about a named individual can only be provided to another person or organisation where disclosure is consistent with Council's obligations under the Government Information (Public Access) Act 2009, the Privacy and Personal Information Protection Act 1998 or the Health Records and Information Privacy Act 2002. These Acts do not prohibit disclosure but set out circumstances in which the Council may provide information including where this is consistent with the purpose for which the information was collected, where the person has consented to the disclosure or was made aware of information of this kind is usually disclosed; or where another Act or legislation permits disclosure. There are also a variety of other circumstances where Council may disclose personal information to other agencies including law enforcement authorities.

What fees are payable?

In accordance with Council's adopted Fees & Charges please forward the completed application form in writing accompanied by a $30 application fee.

Processing of Applications

Your application will be processed as quickly as possible by Council's Public Officer. You will be notified in writing once your application has been assessed.

How Long will my application take?

You will be advised in writing within seven (7) days whether you will be able to access the requested records.
