In 1939 the Library Act was proclaimed in NSW.

Prior to an official library service existing in Maitland, literary services were provided by the West Maitland, East Maitland and Morpeth Schools of Arts.

1 January 1944 the NSW Government proclaimed financial provisions of the NSW Library Act 1939 to ensure Councils adopting and maintaining sufficient library services would receive assistance.

7 June 1944 a Free library was planned for Maitland area.

4 May 1945 Maitland City Council adopted the NSW Library Act 1939. It was the thirtieth council in the state to do so and the thirty-fifth council in NSW to begin a library service.
