Land use planning is undertaken within a strong policy framework.
The Environmental Planning and Assessment Act 1979 and its regulation provide the statutory basis for development in New South Wales. There are State Enviornmental Planning Policies that address specific development issues and areas.
At the local government level, planning is administered by The Maitland Local Environmental Plan 2011 (LEP) and the Maitland Development Control Plan 2011 (DCP).
The LEP contains clauses that establish the permissibility of land uses (eg detached dwelling) in different land use zones (eg R1 General Residential). It also contains clauses that affect how development is designed and carried out. Some of these controls are prescriptive and non-negotiable. Others are advisory and may be varied where Council determines there is merit to do so.
The DCP is a policy that provides greater guidance on the following development matters:
- giving effect to the aims of any environmental planning instrument that applies to the development;
- facilitating development that is permissible under any such instrument;
- achieving the objectives of land zones under any such instrument.
