A development contributions plan is a public document which displays the council’s policy for the assessment, collection, expenditure and administration of contributions. It provides the legal mechanism by which councils may impose a condition of development consent requiring a monetary contribution, dedication of land or both pursuant to section 94.

The following Section 94 Contribution Plans currently apply to the Maitland Local Government Area:  

The Maitland Section 94 Contributions Plan came into effect on 4th May 2006 and applies to all land within the Maitland Local Government Area.

Contributions are levied on a citywide basis for development that may generate a demand for new district or city wide public services and amenities, or the augmentation of existing facilities.

The plan also includes specific additional contributions that apply on a locality or catchment basis specifically for the provision of services or amenities within that particular development catchment. The five catchments are identified in the figures below;

In accordance with this plan, contributions under s94 will be sought for the following types of development:

•      Subdivision of land (urban, rural and rural residential)
•      Medium density housing
•      Expansion or redevelopment of existing residential development; (infill development) that includes either subdivision or additional housing stock (eg dual occupancies)

The Maitland Section 94A Levy Contributions Plan came into effect on 3rd July 2006 and was last amended on 28th July 2008. It applies to all land within the Maitland Local Government Area.  The plan authorises Council to require a developer to pay to the Council a levy of 0.5% of the proposed cost of carrying out the development where the cost of the development is between $100,000 and $200,000 and a levy of 1.0% of the proposed cost of carrying out the development where the cost of the development is greater than $200,000, provided that the Council has not imposed a Section 94 Contribution on the development.  These levies are in accordance with the Ministers Direction under S94E and are effective from 1st December, 2006.

In accordance with this plan, contributions will be sought for all applications for development consent and complying development certificates other than development;

  • For the purpose of a new dwelling or dwellings
  • For the purpose of alterations and additions to existing dwellings
  • Ordinarily incidental or ancillary to the use of a dwelling such as swimming pools, garages, sheds and tree applications.  

Costs reports are required to be lodged with development applications that are subject to the Section 94A levy.  These reports should include details as shown on the following forms.


The Thornton North Section 94 Contributions Plan came into effect on 3rd March 2008 and applies to all land within the Thornton North Urban Release Area.

The plan details new and/or augmented infrastructure and services that will be required as a result of new development in the Thornton North urban release area. These facilities include:

  • Road and Traffic Facilities;
  • Community Facilities;
  • Recreation and Open Space Facilities;
  • Cycleways;

In accordance with the Plan, contributions under s94 will be sought for the following types of development:

• Subdivision of land (urban, rural and rural residential)
• Medium density housing
• Expansion or redevelopment of existing residential development; (infill development) that includes either subdivision or additional housing stock (eg dual occupancies)

In addition to infrastructure, services and facilities specific to the Thornton North release area, development within the Thornton North release area is subject to Council’s City Wide Section 94 Plan (adopted 11th April 2006) which applies for citywide infrastructure to all future development in the LGA.

Accordingly, this Plan operates in conjunction with the Maitland Section 94 Contributions Plan Citywide 2006 and development within the Thornton North release area will be subject to the provisions of both Plans.

Contributions towards Recreation and Open Space, Community Facilities and Administration under the Citywide Plan however are specifically excluded from Thornton North, as these public amenities and services are covered within this Contributions Plan.
