Description
Council is exhibiting a draft State Voluntary Planning Agreement (SVPA) proposed to be made between Maitland City Council (Council), DB20 Pty Ltd (the Developer), and the Minister for Planning and Public Spaces. The agreement relates to land in Anambah, Windella, and Lochinvar where DB20 proposes to upgrade the Wyndella Road / Springfield Drive / New England Highway intersection.
Land and proposed development
DB20 Pty Ltd proposes subdivision and other development for residential and commercial purposes, anticipated to deliver approximately 2,800 dwellings and 5,000 m² of commercial premises over time. This includes current and future planning applications, such as DA/2025/486 (subdivision of part of the land into 173 residential lots, 2 super lots and 1 drainage reserve).

Summary of the draft Agreement
Under the draft SVPA, DB20 Pty Ltd will:
- Deliver the intersection upgrade at Wyndella Road / Springfield Drive / New England Highway, Lochinvar.
- Dedicate (or procure the dedication of) the land on which the upgraded intersection is to be constructed (except any land acquired by Council).
- Dedicate land for a school to the Minister for Education and Early Learning (or nominee) after utility servicing and any necessary remediation.
- Reimburse Council for any land acquisition costs incurred by Council for the intersection works, if required.
- Make an additional contribution to the Minister for Planning and Public Spaces, if needed, where the value of the above contributions is not sufficient to offset the Housing and Productivity Contributions (HPC) that would otherwise be payable under the Ministerial planning order.
Under the draft agreement, Council will:
- Pay DB20 Pty Ltd $5,023,244, an amount based on section 7.11 contributions collected (or to be collected) from the Lochinvar Development Contributions Plan for the intersection upgrade concerned (Item L26).
- Potentially pay up to $551,795 (the “Council Land Amount”) also funded from the Lochinvar Development Contributions Plan for the intersection upgrade concerned (Item L26), if required.
