Renting or leasing property with a pool or spa

The following two items should be obtained at the time that the residential tenancy agreement is entered into to ensure the landlord acknowledges the requirements of the Swimming Pools Act 1992 and that the pool is compliant.

1. The swimming pool, on the residential premises, is registered under the Swimming Pools Act 1992

2. A valid certificate of compliance under the Swimming Pools Act 1992 or a relevant occupation certificate within the meaning of that Act, and a copy of that valid certificate of compliance or relevant occupation certificate provided to the tenant.

Are there any exemptions from the lease provisions?

The swimming pool is situated on land in a strata scheme (within the meaning of the Strata Schemes Management Act 1996) or a community scheme (within the meaning of the Community Land Development Act 1989), which comprises more than two lots.
