Information is released without a formal application or process. For example property ownership details for fencing purposes.
*Please note that if you are enquiring about information for development applications prior to July 2010 you will need to submit a Formal Access application.
A formal application is required if there are specified processes, time frames and review rights. For example complaints, personal information, large amounts of information.
This also applies to requests for information on Development Applications (DA) prior to July 2010.
A Planning Certificate is issued under Section 10.7 of the Environmental Planning and Assessment Act, 1979 (as amended) and gives information on Town Planning controls applying to the land, and other information, which may affect the use or development of the land.
Among other things, it identifies the zoning of the land, any draft Local Environmental Plans relevant to the land, those Development Control Plans and State Environmental Planning Policies which apply to the land, whether any heritage or conservation controls apply to the land and any physical constraints or hazards such as flooding or land contamination.
When land is bought or sold, the Conveyancing Act, 1919 requires a Planning Certificate to be attached to the contract of sale. It may also help an existing owner to decide about the uses of their land.
You can purchase the combined 10.7 (2) and 10.7 (5) Planning Certificate, which, as well as identifying the matters listed above, includes, but is not limited to, additional information such as the history of development consents applying to the land, Tree Preservation, any draft Development Control Plans affecting the land, and whether the land is listed on the State Heritage Register.
The fees for a Combined Section 10.7 (2) & (5) certificate application is $133, or $200 for the express option.
The standard processing time is three to five business days, or you can purchase the express option, which has a faster day two day processing time.
